What are your Responsibilities?
If you are an employer, landlord, or someone in control of premises (e.g. facilities manager or building owner), you have a legal duty to assess and manage the risk of legionella bacteria in water systems.
This applies to all types of workplaces and rental properties—whether you have a simple hot and cold water system, or something more complex.
Key legislation includes:
- The Health and Safety at Work etc. Act 1974
- The Control of Substances Hazardous to Health (COSHH) Regulations 2002
- The Management of Health and Safety at Work Regulations 1999
- Approved Code of Practice (ACoP) L8: Legionnaires’ disease - The control of legionella bacteria in water systems
Failure to comply can lead to enforcement action, prosecution, or significant reputational damage.
What does a Legionella Risk Assessment involve?
A Legionella Risk Assessment is a detailed survey of your water systems to identify potential sources of risk and recommend control measures.
At Red Peak Compliance, our assessments typically include:
- Review of your building’s water systems and layout
- Identification of potential risk areas, such as dead legs, infrequently used outlets, or poorly controlled temperatures
- Checks on hot and cold water temperatures, flow rates, and insulation
- Review of maintenance records and current control measures
- Water sampling and lab testing for Legionella bacteria
- Clear, prioritised report with a control plan where required
Our reports are designed to be easy to follow, with practical guidance and an emphasis on compliance without unnecessary extras.
Water Testing - Included as Standard
We include water sampling and laboratory analysis in all our Legionella Risk Assessments. This gives you peace of mind that the results are based on real data, not just assumptions.
Samples are tested by a UKAS-accredited laboratory and results are included in your report with expert interpretation.
Where positive results are found, we provide clear advice on next steps, including any disinfection or remedial work needed.
When should I have a Legionella Risk Assessment completed?
A Legionella Risk Assessment should be carried out:
- When a property is newly built, purchased, or first rented out
- If water systems are altered or extended
- When there’s a change in occupancy or use of the building
- After an extended period of non-use (e.g. post-refurbishment or closure)
- At least every two years, or sooner if recommended by your previous report
We also offer annual reviews to keep your risk assessment current and help you stay on top of compliance.
